Proposed subsection 83.34(3) of the Criminal Code has been added in recognition of the comment by Judge Kozinski, who sits on the United States Court of Appeals for the Ninth Circuit. This comment may be found in the Humanitarian Law Project, 205 F.3d at page 1,136, that " terrorist organizations do not maintain open books" .
