Le principe d’égalité de traitement de l’article 10 de la directive 2004/17/CE (1), lu ensemble avec son article 51, doit-il être interprété en ce sens que, dans une situation telle celle du litige au principal, il s’oppose à ce qu’une entité adjudicatrice attribue un marché à un soumissionnaire qui n’a pas fait acte de candidature à la présélection et qui n’a donc pas été présélectionné?
Is the principle of equal treatment in Article 10, cf. Article 51 of Directive 2004/17/EC (1) of the European Parliament and of the Council to be interpreted as precluding, in situation such as the one at issue here, a contracting authority from awarding the contract to a tenderer which had not applied for pre-selection and therefore was not pre-selected?
